【摘要】 在技术赋能平台经济快速发展的背景下，新型劳动关系不断产生。新型劳动关系给传统劳动法理论带来诸多挑战，司法实践中关于新型劳动关系的认定也面临诸多困难。解决新型劳动关系相关法律问题，应从不完全劳动关系的性质和从属性内涵入手，深入阐释新型劳动关系认定对劳动者权益保障造成的影响。不完全劳动关系是一类兼具混合性与涵摄性的独立法律关系，修正后的从属性标准在规范新型劳动关系方面仍然具有理论正当性和实践可行性。应坚持以从属性标准为基本原则，完善认定规则体系，包括重视当事人合意、明确从属性权重顺位、厘清从属性强弱判断标准、合理分配举证责任等，以劳动法和民法的协同保护，实现对劳动者权益的靶向赋权与分类保障，同时推动我国劳动法自主知识体系的构建。更多还原

【Abstract】 Against the backdrop of the rapid development of technology-enabled platform economies, new labor relations continue to emerge. These evolving labor dynamics pose numerous challenges to traditional labor law theories, and judicial practice faces significant difficulties in recognizing them. Addressing the legal issues surrounding new labor relations, should begin with examining the nature and the connotation of subordination of incomplete labor relations, building upon this foundation to delve into how the recognition of new labor relations impacts the protection of workers’ rights and interests. Incomplete labor relations constitute a distinct legal category characterized by both hybridity and encompassing nature. The revised subordination standard retains theoretical legitimacy and practical feasibility in regulating new labor relations. It is imperative to uphold the subordination standard as the fundamental principle while improving the identification rule system, including emphasizing the parties’ agreement, clarifying the hierarchical review model for subordination weight, defining criteria for assessing the strength of subordination, and reasonably allocating the burden of proof. Through the coordinated protection of labor law and civil law, targeted empowerment and categorized safeguards for workers’ rights can be achieved, thereby advancing the construction of China’s autonomous labor law knowledge system.更多还原
