【摘要】 急需建立健全符合中国国情的高校师生恋规制政策。国外高校制定师生恋规制政策的正当性依据在于教育公平、道德守正和法律保护等维度，历经从态度相对宽松、到较为温和、再到趋于严厉等三个演进阶段，最终形成有条件禁止、相对全面禁止和绝对全面禁止三种主要类型。政策发展至今，已在实践中形成“自愿同意”得到明确否定、“权力差异”得到充分正视、“告知义务”得到详细规范、“保护学生”得到切实体现等理路。结合国内高等教育管理体制机制及师生恋情况，分别从国家和学校层面提出对策。更多还原

【Abstract】 There is an urgent need to establish and improve sound policy for the regulation of “consensual sexual relationships between faculty and students” in higher education institutions that is in line with China’s national conditions. In international settings, the legitimacy of such regulations is based on principles such as educational fairness, moral integrity, and legal protection. These policies have evolved through three progressive stages, ranging from a relatively lenient attitude to a more moderate one to a more severe one. Prohibition policies have ultimately evolved into three main categories: conditional, relatively comprehensive, and absolute. Over time, these policies have been refined in practice to include explicit denial of “voluntary consent”, a comprehensive acknowledgment of “power imbalances”, detailed requirements for “informational duties” and concrete protections for “students”. Based on China’s higher education management system and the realities of consensual sexual relationships between faculty and students, recommendations at both the national and institutional levels to address these issues can be offered.更多还原
