【摘要】 死者个人信息包含多重利益，涉及多方主体，主要有死者与近亲属、死者与信息存储平台、信息存储平台与近亲属、其他民事私主体与近亲属、公利与私益这五大利益冲突类型。从法律与实践层面的应对举措来看，原则方面：可将“尊重死者意愿优先”原则放置在首要位置；面对利益冲突情形时，辅以“利益主张合法正当必要”原则做必要性和适度性检测；在公利与私益冲突中时刻监测“比例原则”的落实情况。制度构想方面：实践中可借助信息存储平台的技术便利，构建个人信息处分意愿的收集与判定秩序；司法裁判中可借紧急避险角度界定利益保护顺位；立法完善角度可以考虑合理增设其他民事主体的查询处分权限，并辅以死者个人信息保护期限做限制。以原则为指引，以制度创新做构想，共同谋求在死者个人信息保护领域构建利益衡量的可适性秩序。更多还原

【Abstract】 Personal information of deceased individuals involves multiple interests and stakeholders,primarily manifesting in five types of conflicts:between the deceased and their close relatives,between the deceased and information storage platforms,between information storage platforms and close relatives,between other private civil entities and close relatives,and between public and private interests. From the perspective of legal and practical responses:Principle-wise:Prioritize the “respect for the deceased’s wishes” principle.When conflicts arise:Supplement with the “legitimate,justifiable,and necessary” principle to assess necessity and proportionality. In public-private conflicts:Continuously monitor the implementation of the “proportionality principle.” Institutionally:Leverage technological conveniences of information storage platforms to establish order for collecting and determining personal information disposal intentions. In judicial adjudication,the hierarchy of interest protection can be defined through the lens of emergency avoidance;Legislative improvements may consider reasonably expanding access and disposal rights for other civil entities,supplemented by restrictions based on the protection period for deceased individuals’ personal information. Guided by principles and driven by institutional innovation,we collectively seek to establish an adaptable order for balancing interests in the realm of deceased individuals’ personal information protection.更多还原
