【摘要】 互联网时代的到来使得网络犯罪成为全球公害。主权国家逐渐意识到国际合作与治理对于打击网络犯罪的重要性，并开始尝试建构打击网络犯罪国际规则，从区域化路径逐渐走向全球化路径，最终建构起以联合国为框架的打击网络犯罪国际机制。在规则建构过程中，国际社会对打击网络犯罪公约涉及的实体与程序规则均存在不同程度的分歧，主权原则在网络空间的适用成为关键因素。2021年联合国第A/75/L.87/Rev.1号决议后，联合国打击网络犯罪全球公约的制定正式开启。在新公约谈判过程中，中国应当总结自身在打击网络犯罪方面的国内经验，为公约的制定贡献中国智慧，积极参与联合国框架下打击网络犯罪全球规则的制定，在规则制定中坚守主权立场、关照合理诉求、弥合发展差异，致力于建立更加公平合理的打击网络犯罪国际新秩序。更多还原

【Abstract】 The advent of the Internet era has made cybercrime a global public hazard. Sovereign countries have gradually realised the importance of international cooperation and governance in combating cybercrime, and have begun to try to construct international rules for combating cybercrime, gradually moving from the path of regionalisation to the path of globalisation, and ultimately constructing an international mechanism for combating cybercrime with the United Nations as the framework. In the process of constructing rules, the international community has different degrees of disagreement on the substantive and procedural rules involved in the convention against cybercrime, and the application of the principle of sovereignty in cyberspace becomes a key factor. In 2021 after the United Nations resolution A75/L.87 Rev.1, the formulation of the United Nations global convention against cybercrime was formally opened. During the negotiation process of the new convention, China should sum up its own domestic experience in combating cybercrime, contribute Chinese wisdom to the formulation of the convention, and at the same time actively participate in the formulation of global rules for combating cybercrime under the framework of the United Nations, adhere to the sovereignty position, take care of reasonable demands, bridge the development differences in the formulation of the rules, and commit itself to promoting a fairer and more reasonable new international order for combating cybercrime.更多还原
