【摘要】 农地规模化流转市场的发展是提高资源配置效率，促进农业现代化的重要途径，但现实中农地规模化流转面临日益严峻的违约问题。本文基于机会主义行为治理视角分析了农地流转违约风险来源与防范机制，重点阐释了地方政府和村委会在农地规模化流转违约风险防范中发挥的作用，并结合金湖县的违约风险防范案例进行了诠释。结果表明：在防范农地规模化流转违约风险的过程中，村委会基于关系治理发挥着抑制流转双方机会主义行为的作用，进而能够及时发现并制止违约行为，但是由于自身能力限制且存在过度代理风险，导致其在违约风险防范中的作用有限。地方政府通过创设产权交易平台和纠纷仲裁机构，既缓解了事前、事后的机会主义，也激活了村委会治理动机并抑制村委会代理风险，有效弥补村委在违约风险防范中的不足，最终与村委会共同形成了一套完整的违约风险防范体系。研究揭示了地方政府和村委会协同防范农地规模化流转违约风险的实现路径，从违约风险防范机制的角度丰富了农地流转市场高质量发展的理论内涵，也体现了中国集体所有土地资源治理的特色。更多还原

【Abstract】 The development of large-scale farmland rental market is crucial to allocative efficiency and agricultural modernization.However, severe issues of contract breaches bring challenges to this.From the perspective of opportunistic behavior governance, this paper analyzes the sources and prevention of breach risks in the scale transfer of farmland, particularly emphasizes the roles of local government and village committees, and explicitly illustrates them in a case study from Jinhu County.The results indicate that in the process of preventing breach risks in the scale transfer of farmland, village committees, relying on relational governance, play a role in restraining opportunistic behaviors on both sides of the transfer.This enables them to promptly monitor and punish breach behaviors.However, due to their limited capacity and the inherent risk of excessive delegation, their ability in breach risk prevention is constrained.Local governments, by establishing market platform and arbitration organization, not only alleviate pre and post-opportunistic behaviors but also activate the governance motivation of village committees while suppressing the risks of delegation.Ultimately, local government and village committees form a comprehensive breach risk prevention system.This paper reveals the collaboration of local governments and village committees in preventing breach risks in large-scale land market, enriches theoretical implications for high-quality rental market development, clarifies the distinctive features of governing collective land resources in China.更多还原
