【摘要】 刑事在线庭前准备程序是指依托互联网技术进行的庭前准备程序，具有异步性和在线性的特征，应被定位为庭审辅助程序，并在经济性、便利性、充分性等方面为庭审实质化赋能增效。日本和德国的庭前准备程序，以及我国互联网法院的异步审理程序为刑事在线庭前准备程序提供了实践基础。在线庭前准备程序分为“庭前会议型”和“异步回应型”两种类型，可以根据案件争议大小合理选择运行方式。在线庭前准备程序开始于起诉书副本送达完成，结束于开庭传票送达完成。控辩审三方的发言顺序不应受到限制。程序结束后，应当形成记录和报告。线下庭前准备程序可以为在线庭前准备程序提供补充。更多还原

【Abstract】 The criminal online pretrial preparation procedure refers to a pretrial preparation procedure supported by internet technology with the characteristics of asynchronicity and being online. It should be positioned as an auxiliary procedure for the trial and should empower and increase efficiency in terms of economy, convenience, and adequacy for the substantive trial. The pretrial procedures in Japan and Germany, as well as the asynchronous trial procedures in China Internet court, provide a practical basis for the online pretrial preparation procedures. The online pretrial preparation procedure is divided into “pretrial conference” and “asynchronous response”. The operation mode can be selected reasonably according to the size of the case dispute. The online pretrial preparation procedure begins with the serving of the copy of the indictment and ends with the serving of the summons. The order of speeches by the prosecution, defense and court should not be restricted. After the procedure is completed, records and reports shall be made. The offline pretrial preparation procedure is complementary to the online pretrial preparation procedure.更多还原
