“法律之外的创新”:也论人工智能服务提供者的治理
Innovation Outside the Law: Rethinking the Governance of AI Service Providers
【摘要】 生成式人工智能正重塑创作范式,传统版权制度在其高不确定性与低边界清晰度背景下面临制度适配困境。在“法律之外的创新”视角下,版权法不是唯一激励创新的方式,市场机制、社区规范、技术替代与平台规范可在确权之外实现对创新的有效激励。现阶段,版权法战略性“留白”是正确选择。“事后监管+反不正当竞争法兜底”的责任治理结构,“提示词引导”机制的引入,辅以政策激励、税收调节与公共教育等配套机制,可以实现人工智能服务提供者版权侵权的动态治理,为人工智能产业与版权秩序的共生演化奠定制度基础。
【Abstract】 Generative Artificial Intelligence is reshaping the paradigm of creation, posing significant challenges to the adaptability of traditional copyright law amid high technological uncertainty and vague legal boundaries. From the perspective of "innovation outside the law", copyright law is not the only mechanism for stimulating innovation. Market forces, community norms, technological alternatives, and platform governance can offer effective incentives beyond formal copyright entitlements. At the current stage, a deliberate regulatory deferral-or strategic incompleteness-within copyright law is a prudent choice. This Article proposes a governance model grounded in ex post regulation and supplemented by the fallback function of unfair competition law. It further advocates the introduction of a "prompt governance" mechanism, supported by complementary tools such as innovation-oriented policy incentives, tax adjustments, and public education. Together, these elements enable a flexible and adaptive framework for managing copyright liability of AI service providers, and lay the institutional foundation for the co-evolution of the AI industry and the copyright system.
