【Abstract】 Promoting the efficient circulation of data elements and ensuring the healthy development of the digital economy requires addressing both the bottleneck issues that hinder development and the risks and challenges brought about by digital technology. Regulating data behavior as a path to solving the bottlenecks in the circulation of data elements is theoretically and practically feasible in terms of protecting the data rights of enterprises and other entities,combating monopolistic practices, and promoting the efficient flow of data resources. Using legal means to maintain a stable order in the digital economy and society requires a dual approach from both public and private law to prevent and resolve risks in the development of the digital economy. Through a systematic construction from both positive and negative dimensions, effective legal governance can be achieved to ensure the high-quality development of the digital economy.更多还原
