职务发明创造专利权共有关系来源问题研究——以约定共有与法定共有为视角

【摘要】 在职务科技成果赋权改革背景下,职务发明创造专利权共有关系的来源可以得到拓展。职务发明创造专利权共有关系可以源于原始取得或者继受取得,也可以产生于职务发明创造相关的法律行为或者事实行为。《专利法》可以对职务发明创造专利权的约定共有和法定共有作出明确规定。职务发明创造专利权共有关系可以产生于单位与科研人员之间的约定,其中包括事前约定与事后约定两种情形。职务发明创造专利权利归属,可以采用法定共有模式,由法律规定在当事人之间形成专利权共有关系,并解决共有权利行使及共有份额认定等问题。职务发明创造专利共有权关系来源的拓展将有利于当事人充分运用共有模式促进专利技术的实施。

【Abstract】 In the context of reforms aimed at amplifying the recognition and strategic deployment of employees’ scientific and technological achievements, the legal foundations underpinning co-ownership of patents arising from employee-driven inventions and innovations can be significantly broadened. Co-ownership of such patents may be realized through either original or derivative acquisition and may result from legal or factual acts associated with scientific and technological outputs generated by employees. Under patent law, clear regulatory frameworks can be meticulously established to govern both contractual and statutory paradigms of co-ownership pertaining to patents derived from employee ingenuity and inventive endeavors. The co-ownership relationship in a patent right may be formed through comprehensive agreements between the employing entity and the inventor, whether entered before or after the invention is made. Alternatively, a statutory framework for co-ownership may be implemented, whereby the law automatically establishes a co-ownership regime between the parties, thereby ensuring clarity with respect to the exercise of rights in the co-owned patent and the determination of respective ownership shares. Broadening the legal basis for co-ownership of patents stemming from employee inventions and innovations will enable the involved parties to more effectively leverage the co-ownership framework, thereby facilitating the implementation and practical utilization of patented technologies.
