【Abstract】 As a basic principle of ecological conservation rule of law, the precautionary principle should adhere to the value of ecological security, address the integrity and hierarchy of regulated fields, and enhance the proactive and collaborative nature of precautionary measures. Within the Ecological and Environmental Code(hereinafter referred to as the Code), the precautionary principle delivers systemic benefits for ecological conservation rule of law by promoting the realization of the sustainable development and fostering the coordination and coherence of the ecological conservation legal normative system. Given the tension between the normative stability of the Code and the scientific uncertainty inherent in the precautionary principle, the incorporation of the precautionary principle into the Code must be handled with caution. The precautionary principle is a special form of the prevention principle, with differentiated arrangements in the various parts of the Code. The Ecological Conservation Part of the Code should stipulate the precautionary principle as one of the basic principles of ecological conservation rule of law.更多还原
