【摘要】 电信网络诈骗案件中，被害人因羞耻、恐惧、信任缺失等因素常出现沉默状态，由此导致侦查启动延迟、证据链断裂及侦查判断偏差等问题。分析可知，“被害人沉默”现象表现形式多样，具有群体特征，受心理机制、社会文化与制度环境多重因素影响。因此，在实践中，传统上依靠被害人主动报案的机制已难以适应现实需求，侦查机关亟须通过主动获取案源、完善信息引导机制、优化侦查策略来提升侦查效率，并积极推动构建适应“被害人沉默”现象的新型侦查体系。更多还原

【Abstract】 In cases of telecommunications network fraud, victims often remain silent due to factors such as shame, fear, and lack of trust, which leads to delays in the initiation of investigations, breaks in the evidence chain, and deviations in investigative judgments. Analysis reveals that the “victim silence” phenomenon manifests in various forms and has a group characteristic, being influenced by multiple factors such as psychological mechanisms, social culture, and institutional environment. Therefore, in practice, the traditional mechanism relying on victims’ voluntary reporting is no longer sufficient to meet current needs.The investigation authorities urgently need to enhance investigation efficiency by actively obtaining case sources, improving information guidance mechanisms, and optimizing investigation strategies, and actively promote the establishment of a new investigation system that is adapted to the “victim silence” phenomenon.更多还原
