【摘要】 在“双碳”战略目标的引领下，林业碳汇权质押融资作为绿色金融创新的重要实践，对推动生态产品价值实现、促进经济社会绿色转型具有关键作用，但当前其在经济活动中面临诸多法律困境。在质权设立阶段，权利属性模糊导致法律适用争议，登记效力不明与机构分散制约担保效力；在质押存续期间，项目运营与政策风险叠加影响价值稳定，监管机制薄弱加剧市场不确定性；在质权实现时，交易所直接划转的合法性争议，市场流动性不足等因素无不制约着质权的高效实现与担保功能的充分发挥。只有消除障碍才能促进林业碳汇权质押融资健康发展，助力我国绿色低碳经济转型。更多还原

【Abstract】 Guided by the “dual carbon” strategic goals, forest carbon sink right pledge financing, as an important practice of green finance innovation, plays a key role in promoting the realization of ecological product values and advancing the green transformation of the economy and society. However, it currently faces numerous legal dilemmas in economic activities. At the stage of pledge establishment, ambiguous rights attributes lead to disputes over the application of law, while unclear registration effectiveness and scattered registration institutions restrict the effectiveness of security. During the pledge term, the superposition of project operation risks and policy risks affects the stability of value, and the weak regulatory mechanism exacerbates market uncertainty. When enforcing the pledge, disputes over the legality of direct transfer by exchanges and insufficient market liquidity, among other factors, all hinder the efficient enforcement of the pledge and the full play of its security function. Only by removing these obstacles can the healthy development of forest carbon sink right pledge financing be promoted, thereby supporting China’s transition to a green and low-carbon economy.更多还原
