【摘要】 作为建构中国民法自主知识体系的重要一环，我国自主物权法知识体系之建设尚属方兴未艾。历史地看，我国物权法知识的生成演进呈现出从对舶来物权理论的体系化移植到自觉扬弃传统知识体系的自主化建构之轨迹。在既有成就的基础上，我国所要建构的中国自主物权法知识体系须具有扎根本土国情土壤、面向世界文明贡献、因应未来法治变革之应然品格。具有中国特色的《民法典》系中国民法自主知识体系之根本，应以《民法典》物权编中起构筑作用的线索为基点，理解与完善自主物权法知识体系独特的构造脉络。为实现建构中国自主物权法知识体系之宏愿，须加强民法物权规范的内外部自主体系阐释，贯通社科法学与物权法教义学式自主知识，破除物权法自主学说与司法实践沟通壁垒。更多还原

【Abstract】 As an important part of constructing China’s independent civil law knowledge system, the construction of China’s independent property law knowledge system is still in its infancy. From a historical perspective, the generation and evolution of knowledge in China’s property law have shown a trajectory from the systematic transplantation of imported property rights theory to the autonomous construction of consciously abandoning traditional knowledge systems. On the basis of existing achievements, the knowledge system of China’s independent property law to be constructed in our country must have the necessary qualities of being rooted in the local national conditions, contributing to world civilization, and responding to future changes in the rule of law. The Civil Code with Chinese characteristics is the foundation of China’s independent civil law knowledge system. We should take the clues in the property rights section of the Civil Code as the starting point to understand and improve the unique structural framework of the independent property law knowledge system. To achieve the grand goal of constructing a knowledge system for China’s independent property law, it is necessary to strengthen the internal and external Independent system interpretation of property rights norms, integrate interdisciplinary and property law doctrine based Independent knowledge, and break down communication barriers between property law theory and judicial practice.更多还原
