【摘要】 【目的】作为非物质文化遗产的重要组成部分，传统工艺美术与中华民族传统文化的传承与保护密切关联。研究传统工艺美术的国际法律保护机制，是实现对传统工艺美术全方位保护的重要途径。【方法】从国际法视野，对比分析传统工艺美术的相关概念，深入探讨其现行保护模式，明确其在知识产权保护体系中的定位。【结果】世界知识产权组织（WIPO）和联合国教科文组织（UNESCO）在传统工艺美术的保护实践中仍面临名录管理体系不完善及与国际贸易规则相冲突的问题，且在关键议题上，知识产权对传统工艺美术的保护制度建构存在显著分歧。【结论】为了有效保护传统工艺美术，亟需完善知识产权保护机制的制度性建构，并对现行国际法文件进行相应修订与补充。更多还原

【Abstract】 [Purpose] As a vital component of intangible cultural heritage, traditional arts and crafts are closely linked to the inheritance and preservation of Chinese traditional culture. It is essential to achieve comprehensive protection on traditional arts and crafts by studying the international legal protection mechanisms for traditional arts and crafts. [Method] From the perspective of international law, concepts related to traditional arts and crafts are conducted a comparive analysis,existing protection models are explored, and their position within the intellectual property protection framework is clarified. [Result] The World Intellectual Property Organization(WIPO) and the United Nations Educational, Scientific and Cultural Organization(UNESCO) still face challenges in protecting traditional arts and crafts, including incomplete management systems for heritage lists,conflicts with international trade rules,and significant divergences in the construction of intellectual property systems on protection of traditional arts and crafts regarding key issues. [Conclusion] To effectively protect traditional arts and crafts, it is imperative to improve the institutional construction of intellectual property protection mechanisms and to revise and supplement the relevant international legal documents accordingly.更多还原
