【摘要】 揭示《公共图书馆法》软法性条款的配置逻辑、效力生成路径,可以为新时期《公共图书馆法》软法性条款实施效力的强化提供指引。本文采用内容分析法,识别《公共图书馆法》设置的软法性条款,进一步关注生成逻辑、效力运转机制等议题,提出效力强化的可行策略。依据性规范效力、领域法的共同属性和国家法立法旨归共同促使《公共图书馆法》配置以倡导性软法条款为主导,涵盖宣示性软法条款、赋权性软法条款、陈述性软法条款、半软法性条款的软法性条款结构。权力主导型压力机制、资源依赖型引导机制和政策协同型保障机制是维持《公共图书馆法》软法性条款效力运行的独特机制。为了推动《公共图书馆法》从“文本的法”走向“实施的法”,应当构建软法性条款和硬法性条款的互动协同机制,以达成良法善治目标、完善配套制度体系建设,构筑公共图书馆事业发展的法治保障体系、激活内生引导型资源,唤醒自我实施机能。图1。表3。参考文献33。更多还原

【Abstract】 This paper reveals the configuration logic and effectiveness generation path of the soft law provisions of the Public Library Law, and provides guidance for strengthening the implementation effectiveness of the soft law provisions of the Public Library Law in the new era. The theme content analysis method is used to identify the soft law provisions set by the Public Library Law, further attention is paid to issues such as generation logic and effectiveness operation mechanism, and feasible strategies are proposed for effectiveness. Based on the legal effect of the law, the common attributes of the field law and the legislative purpose of the basic law, the configuration of the Public Library Law is dominated by the soft law provisions of the advocacy, covering the soft law provisions of the declarative soft law provisions, the empowering soft law provisions, the declarative soft law provisions, and the soft law provisions of the semi-soft law provisions. The power-oriented pressure mechanism, resource-dependent guidance mechanism and policy-coordinated guarantee mechanism are the unique mechanisms to maintain the effectiveness of the soft law provisions of the Public Library Law. In order to promote the Public Library Law from “text law” to “implementation law”, we should build an interactive and collaborative mechanism between soft law provisions and hard law provisions, so as to achieve the goal of good law and good governance, improve the construction of supporting system, build a legal guarantee system for the development of public libraries, activate endogenous guiding resources, and awaken self-implementation functions. 1 fig. 3 tabs. 33 refs.更多还原
