教育法律责任规范入典的三重逻辑
The Triple Logic of the Codification of the Norms of Legal Liabilities in Education
【摘要】 教育法律责任是法治系统的重要组成部分,也是教育法典编纂不可缺少的一环。实现教育法律责任规范入典需要有力的理论支撑。价值层面,有助于厘清和践行《宪法》中的教育规范条款,最大化发挥教育法律责任的特定功能,进一步实现教育法律规范体系化的编纂目标。法理层面,法律责任既是对教育法典中主体权利和义务的必然回应,又是教育法典编纂遵照基本原则的重要体现,还是教育行政执法的理论依据。政策层面,以增强立法系统性、整体性、协同性、时效性为目标,党和国家、立法机关、各级政府就教育法律责任分别作出需求与回应。教育法典法律责任的编排体例宜采取“总则+分则”式,总则中专章对教育法律责任作一般条款规定,分则中对特殊教育阶段和教育类型的法律责任作出具体条款规定。
【Abstract】 Educational legal liabilities is an important part of the rule of law system and an indispensable part of the codification of the education code. Realizing the norms of educational legal liabilities into the code requires strong theoretical support. At the value level, it helps to clarify and practice the educational normative provisions in the Constitution, maximize the specific function of educational legal liabilities, and further realize the codification goal of systematizing educational legal norms. At the jurisprudence level, legal liabilities is not only an inevitable response to the rights and obligations of the subjects in the education code, but also an important manifestation of the basic principles of the education code, as well as a theoretical basis for education administration and law enforcement. At the policy level, with the goal of enhancing the systemic, holistic, coordinated and responsive nature of legislation, the Party and the State, the legislature, and governments at all levels have made their respective demands and responses to the legal liabilities in education. The organization of the legal liabilities of the education code should be in the form of “general provisions + sub-legal provisions”, with a special chapter in the general provisions stipulating general provisions on legal liabilities in education, and sub-legal provisions stipulating specific provisions on legal liabilities for special education stages and types of education.
