【摘要】 美国次级经济制裁行为的合法性在国际法上备受质疑。人类命运共同体理念是我国基于当前的国际形势提出的全新概念，此理念已在国际社会得到广泛的认同，为分析美国次级经济制裁行为的违法性提供了理论指导。以人类命运共同体理念为视角，采用比较分析法、案例分析法等方法，对美国次级经济制裁行为进行研究，分析得出美国次级经济制裁行为在人类命运共同体理念中的人权、发展权以及全球治理观原则上具有违法性，进而得出坚持完善国际人权协商机制，树立“以合作谋发展”的理念，构建新型的全球治理观是一条必经的道路，旨在为推动国际社会向着更加公正、平等和可持续的方向发展贡献一份力量。更多还原

【Abstract】 The legitimacy of the United States secondary sanction has been questioned in international law. The proposal of building a global community of a shared future is a brand-new concept put forward by our country based on the current international situation, which has been widely recognized in the international community, and the proposal of building a global community of a shared future provides theoretical guidance for analyzing the illegality of the U.S. secondary sanction. Taking the proposal of building a global community of a shared future as the perspective, the research methods of comparative analysis and case analysis method and other methods are used to study the U.S. secondary economic sanctions, and the analysis concludes that the U.S. secondary sanction have the illegality in the principles of human rights, the right to development, and the concept of global governance in the proposal of building a global community of a shared future, and then concludes that it is a necessary path to insist on perfecting the international human rights consultation mechanism, establishing the principle of “cooperation for development” and build a new type of global governance, with the aim of contributing to the development of the international community in the direction of greater justice, equality and sustainability.更多还原
