【摘要】 在面对众多自然人之间借款合同的司法定性、法律适用问题时，裁判者在借款合同法律关系保护和债权人保护之间作出何种价值判断，是民法自然人借款合同纠纷问题中的事实判断问题。对自然人借款合同相关的几篇判决文书加以分析可见，裁判者对自然人之间通过意思自治成立借贷或是投资、合伙、赠与等各类不同行为认定准则的确定，可以看出裁判者面对“相似借贷案例”作出的价值判断，得出其相应的裁判思路。更多还原

【Abstract】 When facing the judicial qualitative and legal application issues of loan contracts between numerous natural persons, the judge’s value judgment between the protection of the legal relationship of the loan contract and the protection of the creditor is a factual judgment issue in civil law natural person loan contract disputes.Through the analysis of several judgment documents related to natural person loan contract, it can be seen that the judge determines the criteria for different behaviors such as lending or investment, partnership and donation between natural persons through voluntary autonomy, and it can be seen that the judge makes value judgment in the face of "similar loan cases" and obtains its corresponding judgment ideas.更多还原
