【摘要】 湖北高校专利转化面临专利价值度偏低、供求信息不对称、谈判复杂成本高昂以及专业转化平台和人才队伍供给不足的问题，专利开放许可制度基于成本效益理论和利益平衡理论基础，可以为高校专利成果转化提供助力。目前，专利开放许可制度还面临开放许可信息整合不够细致、开放许可专利价值评估不够准确、开放许可激励政策不够明确、许可纠纷解决手段不够高效及许可交易监督机制不够完善的问题。文章认为可以从建立开放许可前置审查机制、完善开放许可信息服务平台、完善许可费确定和变价机制、明确开放许可的全过程激励政策、增加行政裁决、行政仲裁手段及构建知识产权信用监管体系方面进行优化。更多还原

【Abstract】 The patent transformation in Hubei universities faces problems such as low patent value, asymmetric supply and demand information, complex and costly negotiations, and insufficient supply of professional transformation platforms and talent teams. The patent open license system is based on cost-benefit theory and interest balance theory, and can provide assistance for the transformation of patent achievements in universities. At present, the patent open licensing system still faces problems such as insufficient integration of open licensing information, inaccurate evaluation of open licensing patent value, unclear incentive policies for open licensing, inefficient means of resolving licensing disputes, and inadequate supervision mechanisms for licensing transactions. The article suggests that optimization can be achieved by establishing a pre examination mechanism for open licenses, improving the information service platform for open licenses, improving the mechanism for determining and adjusting license fees, clarifying the incentive policies for the entire process of open licenses, increasing administrative rulings, arbitration methods, and constructing a credit supervision system for intellectual property.更多还原
