【摘要】 完善房地产发展基础性制度是构建房地产发展新模式的法治前提。房地产发展模式转型需要从基础性制度层面实现治理方式创新。本文基于治理现代化视角，以房地产发展基础性制度为研究对象，坚持问题导向和目标导向，在分析房地产传统发展模式制度性缺陷的基础上，阐释了房地产发展新模式的内涵，论述了房地产发展基础性制度的创新要点，进而探索将制度优势转化为治理效能的路径，旨在促进新旧模式、新旧制度的平稳过渡，以高质量法治保障房地产业高质量发展。结果表明：房地产传统发展模式的制度性缺陷制约了房地产业高质量发展；房地产发展模式转型应以基础性制度创新为支撑；法治是促进房地产业高质量发展的最好治理方式。基于上述结论，本文提出如下政策建议：一是构建房地产发展新模式的本质是推进治理现代化，治理现代化的根基在于基础性制度创新；二是房地产发展新模式与基础性制度的协同创新，应遵循房地产发展自身规律以及改革与法治良性互动规律；三是从实现治理现代化的要求出发，积极探索房地产发展新模式与基础性制度的协同创新，是推进中国式房地产现代化的必由之路。更多还原

【Abstract】 Improving the fundamental institutional framework for real estate development is the legal prerequisite for establishing a new model of real estate development. The transformation of the real estate development model requires innovations in governance approaches at the level of fundamental institutions. From the perspective of governance modernization, this paper focuses on fundamental institutions in real estate development, adhering to both problem-oriented and goal-oriented approaches. Based on an analysis of the institutional flaws in the traditional real estate development model, the paper explains the connotation of the new real estate development model, discusses the key points of institutional innovation, and explores the pathways for transforming institutional advantages into governance effectiveness. This ensures a smooth transition between the old and new models and institutions, providing high-quality legal guarantees for the highquality development of the real estate industry. The results indicate that:(1)The institutional flaws of the traditional real estate development model have constrained the high-quality development of the real estate industry;(2)The transformation of the real estate development model must be supported by fundamental institutional innovation;(3)The rule of law is the most effective governance mechanism to promote the high-quality development of the real estate industry. Main Conclusions:(1)The essence of establishing a new model for real estate development is to promote governance modernization, and the foundation of governance modernization lies in the innovation of fundamental institutions;(2)The collaborative innovation between the new model of real estate development and fundamental institutions should adhere to the inherent laws of real estate development, as well as the positive interaction between reform and the rule of law;(3)From the perspective of achieving the requirements of governance modernization, actively exploring the collaborative innovation between the new development model and fundamental institutions is the only path to advancing the modernization of real estate with Chinese characteristics.更多还原
