【摘要】 《中国共产党党内法规制定条例》和《中国共产党党内法规解释工作规定》都明确规定“党内法规的解释同党内法规具有同等效力”,但关于“同等效力”的概念意涵学界却莫衷一是。虽然党内法规解释与党内法规文本具有诸多共通性，但两者在客观上的差异，使得党内法规解释与党内法规文本在规范效力、时间效力和空间效力上难以做到完全的等同。基于此，文章从“同等效力”的内在逻辑入手，从上述三个效力维度对“同等效力”的概念进行厘清，并在此基础上提出了完善“同等效力”制度的具体建议。更多还原

【Abstract】 The interpretation of intraparty rules and regulations of the CPC shall have the equal effectiveness as intraparty rules and regulations of the CPC. It is the explicit requirements of Regulations on the Formulation of Intraparty Rules and Regulations of the CPC and Regulations on Interpretation of Intraparty Rules and Regulations of the CPC. However, the meaning of the concept of “equal effectiveness” is still a matter of the academic discussion. Although the interpretation of intraparty rules and regulations and the text of intraparty rules and regulations have a lot in common, but there are objective differences between them. Those differences make it difficult to achieve complete equivalence between the interpretation of intraparty rules and regulations and the text of intraparty rules and regulations in terms of normative effectiveness, time effectiveness and spatial effectiveness. Based on this, it is helpful to clarify the connotation and extension by analyzing the internal logic of “equal effectiveness” from the above three effectiveness dimensions, thus putting forward specific suggestions to perfect “equal effectiveness” system.更多还原
