【摘要】 检察委员会对案件或者事项进行决议在本质上是一个履行检察决策权的过程。其决策权的发展经历了一个由不享有决策权，到享有半完全决策权，再到享有完全决策权的集体决策强化的过程。从决策理论来看，当前规范层面的检察委员会决策权主要呈现为以宏观决策、群体决策和行政决策为主导的理论特质，其实践运行也理应遵循这三种决策类型的基本规律。但实践层面，检察委员会的个案决策占据了检察委员会的大部分内容；委员的个体意见被群体意见所稀释；检察委员会的司法决策事项采用行政决策程序处理，这有违检察委员会决策权的理论特质和运行规律，阻碍了检察委员会的良性发展。未来，应通过强化检察委员会的议事职能，缩限议案职能；强化检察委员会委员个体意见表达和个人责任的承担；将检察委员会的决策程序由单轨设计转向双轨设计等方式来实现检察委员会的科学运转。更多还原

【Abstract】 The procuratorial committee’s decision on a case or matter is essentially a process fulfilling the procuratorial decision-making power. The development of its decision-making power has experienced a process from not having decision-making power, to having semi complete decision-making power, and then to having the entire decision-making power. From the perspective of decision-making theory, the decisionmaking power of the procuratorial committee at the current normative level is mainly characterized by the theoretical characteristics of macro decision-making, group decision-making and administrative decisionmaking. Its practical operation should also follow the operation rules of these three types of decision-making.However, in practice, the case decision of the procuratorial committee occupies most of the contents of the procuratorial committee. Individual opinions of members are diluted by group opinions. The judicial decisionmaking matters of the procuratorial committee are handled by administrative decision-making procedures.These violate the theoretical characteristics and operational rules of the decision-making power of the procuratorial committee and hinder the benign development of the procuratorial committee. In the future, it is necessary to strengthen the function of resolution matters and weaken the function of resolution cases of the procuratorial committee and strengthen the expression of individual opinions and the assumption of individual responsibilities of members of the procuratorial committee.
