【摘要】 习近平外交思想是新时代中国特色社会主义思想的重要组成部分，是马克思主义基本原理同中国外交实践相结合的重大理论创新，而涉外法治则是习近平外交思想和法治思想的重要“枢纽”。构建中国特色涉外法律体系是贯彻习近平外交思想的重要方式，是丰富外交斗争工具箱，维护国家主权、安全和发展利益，积极参与全球治理和改革的法律基础保障。习近平外交思想为构建中国特色涉外法律体系框定目标、引领方向，明确了涉外法律体系的立法重点。中国特色涉外法律体系的构建应满足统筹国内国际两个大局的需求，契合中国特色大国外交战略，以“宪法—对外关系法—不同板块涉外法律规则”的内在机理和外在结构呈现为上下有序、相互照应的有机整体。处于底层每一板块的法律规则应包括国际法的内化、国内法的外化、外国法适用、执法和司法程序、国际合作等内容，而《对外关系法》在宪法与不同板块涉外法律规则之间起着承上启下的作用。《对外关系法》是习近平外交思想的重要法律实践成果，实现了对外事工作的统筹协调，为新时代中国对外交往提供了行动指南和法律遵循，是新时代运用法治思维做好对外交往工作的重要举措。更多还原

【Abstract】 Xi Jinping Thought on Diplomacy is an important component of the Thought on Socialism with Chinese Characteristics for a New Era and a significant theoretical innovation that combines the basic principles of Marxism with China’s diplomatic practice.The rule of law involving foreign parties is the important ’hub’ connecting the Xi Jinping Thought on Diplomacy with Xi Jinping Thought on the Rule of Law.The construction of the Chinese legal system involving foreign parties is aimed at implementing Xi Jinping Thought on Diplomacy,enriching diplomatic toolbox,safeguarding China’s national sovereignty,security and development interests,and providing legal basis for China’s active participation in global governance and reform.Xi Jinping Thought on Diplomacy has set the goal,point the direction,and identify the legislative focus for building a legal system involving foreign parties with Chinese characteristics.The construction of such a system should meet the demand of considering both domestic and external situations in a coordinative way,and align with the diplomatic strategy of China as a major country with its own characteristics.The internal mechanism and external structure of “Constitution-Law on Foreign Relations-law and rules involving foreign parties in different sections” should compose and be presented as an organic whole where all parts not only stay orderly in hierarchy,but also correspond to each other.The legal rules in each section at the bottom should include the localization of international law,the externalization of domestic law,the application of foreign law,enforcement and judicial procedure,international cooperation,etc.The Law on Foreign Relations serves as a connection between the Constitution and the law and rules involving foreign parties in different sections.The Law on Foreign Relations is an important achievement in the legal practice of Xi Jinping Thought on Diplomacy.As an important measure of using the rule-of-law thinking in China’s diplomatic work in the new era,the Law has promoted coordination and provided action and legal guidelines for the work.更多还原
