【摘要】 “春秋决狱”的特点在于将儒家经义作为司法机关断案的根据，是一种基于实现个案公正目标而形成的特殊司法思维，注重在优先适用法律条文的前提下，对具体案件进行情与理的价值衡量。而英国衡平法亦将“公正”“正义”等价值理念作为法官审判的依据。通过将“春秋决狱”与英国衡平法进行比较可知，二者虽然在产生根源、对后世影响、适用场景、思维模式上均不相同，但都蕴含着衡平理念这一特殊法律思维。应当看到，衡平理念主要是通过与法官裁量权的结合来发挥作用的，并且与司法正义息息相关。更多还原

【Abstract】 Chunqiu Jueyu is characterized by citing Confucian classics such as Spring and Autumn Annals as the basis for hearing cases. It is a special judicial thinking in aim of justice in individual cases, highlighting the analysis of sentiment and reason in a specific case while prioritizing the application of legal texts. “British Rule of Equity” also regards “fairness” and “justice” as the basis for hearing cases. Through a comparative study of Chunqiu Jueyu and “British Rule of Equity”, it can be seen that despite their differences in origins, influences on later generations, application scenarios, and thinking modes, they both contain the special legal thinking of the concept of equity. It should be seen that the concept of equity plays a role mainly through a combination with the discretion of judges and is closely related to judicial justice.更多还原
