【摘要】 政策工具使用是探索宅基地政策试点地区所有权、资格权和使用权分置有效实现形式的重要考量。筛选中国16个宅基地政策试点地区的30项“三权分置”政策文本，运用内容分析法挖掘出329个政策文本单元类目，总结宅基地“三权分置”政策试点地区的政策工具使用状况。研究发现：政策试点地区政策工具整体结构不均衡，偏好使用经济型政策工具，自愿有偿退出和有偿使用政策工具应用过溢。组织型、管制型和信息型政策工具适中，自愿型政策工具使用偏少。试点地区宅基地三项权能的政策工具运用存在明显差异，宅基地使用权赋权扩能的试点取向凸显，而集体土地所有权政策工具试点改革相对较少。因此，合理调整不同类型政策工具的使用结构，兼顾宅基地三项权能政策工具组合应用，总结试点成果经验，逐步拓展试点范围，推动宅基地“三权分置”改革。更多还原

【Abstract】 The use of policy tools is an important consideration to explore the effective implementation form of the separation of ownership,qualification right and use right in the pilot areas of homestead policy. This paper selects 30 " separation of three rights" policy texts from 16 homestead policy pilot areas in China,uses content analysis method to dig out 329 policy texts unit categories,and summarizes the use of policy tools in homestead " separation of three rights" policy pilot areas. The results show that the overall structure of policy instruments in policy pilot areas is not balanced,preferring to use economic policy instruments,voluntary paid exit and paid use of policy instruments are overused. Organizational,regulatory and informational policy tools are moderate,while voluntary policy tools are less used. There are obvious differences in the use of policy tools of the three rights and capabilities of homestead in the pilot areas.The pilot orientation of empowerment and capacity expansion of homestead use rights is prominent,while the pilot reform of collective land ownership policy tools is relatively less. Therefore,we should reasonably adjust the use structure of different types of policy tools,give consideration to the combined application of the three power policy tools of homestead,sum up the experience of the pilot results,gradually expand the scope of the pilot,and promote the reform of " three power separation" of homestead.更多还原
