【摘要】 第三方监管是保证企业合规整改效果的有益手段，考察域外尤其是美国的相关实践，我们发现涉案企业第三方监管存在适用上例外而非原则、地位上中立且专业、功能上预防而非惩罚和不断强化的监督等特点。中国在试点基础上创设了第三方监督评估机制，给出了涉案企业第三方监管的中国方案，该机制具有普遍适用性、超然中立性、行业专业性、多重监督性和高度透明性等特点。未来应在明确制度逻辑和厘清三方关系的基础上，继续强化专业监管和有效监管。更多还原

The Supreme People’s Procuratorate has created Third Party’s Inspection System on the basis of the countrywide pilots, China’s Solutions to Corporate Compliance Monitors is given.This system has the following characteristics: generally applicable、detached neutrality、specialization adaptation、multiple supervision and highly transparent.
