【摘要】 伴随着信息化商业模式的背景下，人脸识别技术带来的商业价值越发明显，人脸识别技术商业化的应用是大势所趋。其具有技术风险、处理风险、犯罪风险、社会风险、管理风险等风险特征，均为人脸识别技术商业化过程中不可避免的。从不同的风险角度进行阐述，找出人脸识别技术商业化应用过程中法律规制的问题，通过对法律规制问题的研究，提出“合理标准”的分级管理制度、完善明确存储的条件、增设刑法罪名和设立数据专员等措施来完善人脸识别技术商业化应用风险的法律规制。更多还原

【Abstract】 Under the background of the information technology business model, face recognition technology brings more and more obvious commercial values and the application of face recognition technologyis the general trend. It has risk characteristics such as technical, processing, crime, social, and management risks, all of which are unavoidablein the commercialization of face recognition technology. From different risk perspectives, the paper finds out the problems of legal regulation in the process of commercial application of face recognition technology. Through the research of legal regulation issues, the paper proposes a hierarchical management system of “reasonable standards”, improves the conditions of clear storage, adds criminal charges and sets up data commissioners to improve the legal regulation of the risk of commercial application of face recognition technology.更多还原
