【摘要】 制度主义是监管理论中的重要流派或监管研究中重要的理论视角。国内已有研究尚未系统解读监管制度主义理论。本文致力于国际相关文献的梳理综述，内容包括监管制度主义的起源和发展、监管制度主义的流派和主张，目的是给国内相关研究提供理论视角和方法上的启示和借鉴。监管制度主义与新制度主义关联密切，基于研究问题的差异性，本文将监管制度主义流派分为三类：一是关注监管病理及制度设计，探讨如何设计制度和制度间关系来避免监管过程存在的监管病理；二是关注监管发展和制度内部力量，聚焦思考组织内力量如何驱动与影响监管发展；三是关注监管网络与监管空间，聚焦探讨监管网络中策略的使用、协调机制的建立及监管空间中各种力量对监管发展的影响。监管的制度主义理论对当下中国的监管实践具有一定的启发意义。更多还原

【Abstract】 Institutionalism is an important genre in regulatory theory or an important theoretical perspective in regulatory research. Domestic research has not yet systematically interpreted the theory of regulatory institutionalism. This article is dedicated to a comprehensive review of relevant international literature,including the origin and development of regulatory institutionalism,the schools and propositions of regulatory institutionalism,with the aim of providing theoretical perspectives and methodological inspiration and reference for domestic research. Based on the differences in research questions,this article categorizes regulatory institutionalism schools into three categories: firstly,it focuses on regulatory pathology and institutional design,exploring how to design institutions and their relationships to avoid regulatory pathology in the regulatory process. Secondly,some researchers focus on regulatory development and internal institutional forces,focusing on how internal forces within the organization drive and influence regulatory development. Thirdly, others focus on the regulatory network and regulatory space,focusing on exploring the use of strategies in regulatory networks,the establishment of coordination mechanisms,and the impact of various forces in regulatory space on regulatory development. The institutionalist theory of regulation still has certain guiding significance for the current regulatory practice in China.更多还原
