云计算技术支持下的跨国商事网络仲裁机制构建(英文)

【摘要】 仲裁是当前国际商事活动纠纷解决的主要形式,跨国商事网络仲裁在当前经济环境与商事实践中的重要性日益凸显。国际商事仲裁的核心特征在于自决性与跨国性,其特征为仲裁运作机理的创新提供有效保障。跨国商事网络仲裁实质上是以自主创新回应当代国际商事活动复杂性的一种方式,其以网络平台为基础、以法律环境为保障。我国跨国商事网络仲裁实践存在法律制度配合不足、网络平台固有问题凸显、其他法律服务协同不充分等问题。我国推进仲裁法修订,进一步完善送达条款与证据条款,需以云计算与智能化改造网络仲裁平台,在平台运作上注重数据保密与当事人自主;需强化仲裁机构同其他法律服务机构的一体化整合,推进仲裁机关与司法机关的数据衔接。

【Abstract】 Arbitration is currently the main form of dispute resolution in international commercial activities, and transnational commercial cyber-arbitration is becoming increasingly important in the current economic environment and commercial practice. The core features of international commercial arbitration are self-determination and transnationality, which provide an effective guarantee for innovation in the operational mechanism of arbitration. In essence, transnational commercial cyber-arbitration is a way to respond to the complexity of contemporary international commercial activities with autonomous innovation based on a network platform and guaranteed by a legal environment. The practice of transnational commercial cyber-arbitration in China needs to improve its cooperation of legal systems, inherent problems of the network platform, and insufficient coordination of other legal services. China promotes the amendment of the Arbitration Law further to improve the service of process and evidence clauses. Arbitration practice needs to transform the cyber-arbitration platform with cloud computing and AI and focus on data confidentiality and party autonomy in the platform’s operation. The governments need to strengthen the integration of arbitration institutions with other legal service institutions and promote the data connection between arbitration and judicial authorities.
