【摘要】 环境权是环境法律体系的基石性权利，探讨环境权入典问题是我国环境法典编纂的基础性工作，也是回应人民群众对优美生态环境权利需求的重要使命。环境权入典的基本理路，应在检视已有环境权基本理论的基础上，引入权利束的分析框架，将环境权视为一种囊括多种具体权利类型在内的权利集合。阐明环境元权利束下，环境权实体性、程序性及救济性规定的相关内容，明确环境权入典具备的价值意蕴与现实基础。我国环境权入典实施路径，应采用“先集中后分散”的入典模式，同时与环境法典“总则—分编”的编纂体例相结合，采用“一元多层”的入典路径，在总则编中明确一般性环境权，将环境权实体性规定、程序性规定以及救济性规定有机融贯于环境法典的四大分编之中。更多还原

【Abstract】 Environmental right is the cornerstone right in the environmental legal system. Exploring the entry of environmental right into the code will be the basic work of the compilation of environmental code in China, and also an important mission to respond to the people’s demand for a beautiful ecological environment. The basic principle of introducing environmental rights into the code in China, should introduce the right analysis framework on the basis of examining the existing basic theory of environmental rights, regard environmental rights as a collection of rights that includes multiple specific rights types, clarify the content of substantive, procedural and relief provisions of environmental rights under the “Environmental meta-rights”, and clear the value implication and realistic basis of environmental rights entering the code. The implementation path of environmental rights into the code, should adopt the mode of “centralized and then scattered”, and combine with the compilation style of “from general rules to divisions” of the environmental code. Using the code path of “unary but multilayer”, general environmental rights are clarified in the general rules, and the substantive, procedural and relief provisions are organically integrated into the four divisions of the environmental code.更多还原
