【摘要】 数字法治时代,裁判文书网上公布过程中不合规披露的未成年人个人信息传播迅速、影响深远,研究文书公布中的未成年人个人信息披露合规风险,可为未成年人个人信息保护提供对策。通过研究文书公布中未成年人个人信息披露合规制度的构成,检视现行文书公布中不合规现象,分析裁判文书公布主体的未成年人个人信息披露合规困境,发现当前文书公布中存在信息脱敏不到位、信息公开不合规的风险。基于对不合规原因的分析和总结,文章回应文书公布中未成年人个人信息披露与保护的需求,提出完善文书公布中未成年人个人信息披露合规制度、落实文书公布中未成年人个人信息披露合规义务等对策。更多还原

【Abstract】 In the era of the digital rule of law, the non-compliant disclosure of personal information of minors during the process of document release of the online judicial document network spreads rapidly and has far-reaching impacts. Research on compliance risks of disclosing the personal information of minors in document releases can provide countermeasures for protecting the personal information of minors. By studying the composition of compliance regulations for disclosing the personal information of minors in document release,examining current non-compliant phenomena of document release as well as analyzing the compliance dilemma of disclosing the personal information of minors by the main body of judicial document release, it is found that there are risks of inadequate desensitization of information and non-compliance with information disclosure in current document release. Based on the analysis and summary of noncompliant reasons, this paper responds to the need for disclosure and protection of the personal information of minors in document release and proposes countermeasures such as improving compliance regulations for disclosing the personal information of minors in document release and implementing compliance obligations for disclosing the personal information of minors in document release.更多还原
