【摘要】 集体成员资格认定对保障农村妇女权益具有重要现实意义。现阶段，妇女集体成员身份模糊化是引发其权益被侵害的重要原因，农村集体成员身份确认具有复杂性，需要统筹考虑户与户内成员关系、成员资格的实然与应然问题以及成员身份与集体股权分配等问题方能有效保障女性群体的权益。通过回溯农业合作化运动以来的制度沿革可以发现，在农村集体经济形成和发展过程中，党和国家始终强调农村妇女的成员身份，维护和保障农村妇女的合法权益。结合相关个案和司法实践分析，农村妇女集体成员权受损的现实表征既体现在因土地征收、集体收益分配等导致的财产性权益被侵害，又表现为参与集体资产经营及监督决策的社会性权益被剥夺。目前，新修订的《妇女权益保障法》畅通了妇女作为农村集体成员权益被侵害的司法救助和公益救济途径，为今后农村妇女维权工作提供了法律指引。更多还原

【Abstract】 Recognition of membership status in a collective is of great significance to safeguarding the rights and interests of rural women.At the present stage, the blurring of women’s membership in a collective is an important reason for the infringement of their rights and interests.The recognition of membership in a rural collective is complex, and it is necessary to consider the relationship between household and intra-household membership, the actual and contingent issues of membership, and the distribution of membership and collective equity in order to effectively protect women’s rights and interests.By looking back at the institutional history of the agricultural cooperative movement, we can find that during the formation and development of the rural collective economy, the Party and the State have always emphasized the membership status of rural women and safeguarded the legitimate rights and interests of rural women.Combined with relevant cases and judicial practice, this study shows that the incidents of rural women’s impaired collective membership rights during land expropriation and thereafter the distribution of compensation within the collective are not only the infringement of their property rights.But as well, these rural women are also deprived of their social rights to participate in collective asset management and supervise decision-making.The newly revised Law on the Protection of Women’s Rights and Interests has now opened up avenues for judicial relief and public welfare relief for women whose rights and interests as members of rural collectives have been violated, providing legal guidance for the future work of protecting rural women’s rights.更多还原
