【摘要】 地方性法规中的党的领导条款是“党的领导”入法的规范表达形式，对其发展历史、分布特点、样态类型、影响因素进行梳理和分析，能够在学理层面为地方性法规设置党的领导条款提供助益。从历史发展过程看，在中央立法观念的影响下，地方性法规中党的领导条款的设置总体经历了三个阶段，即鲜见党的领导条款阶段、增加党的领导条款阶段以及党的领导条款规模化阶段。从分布特点看，地方性法规中党的领导条款在数量上与立法内容的政治性强弱、立法层级的高低呈正相关关系，在位置上集中在总则部分。从样态类型看，根据规定内容的不同，地方性法规中党的领导条款主要有原则型条款、职权型条款、义务型条款三种类型。从影响因素看，地方立法权限是在地方性法规中设置党的领导条款的基础，党内法规的相关规定构成是否在地方性法规中设置党的领导条款的重要考量，可执行性则构成在地方性法规中设置党的领导条款的目标追求。在“党的领导”入法全面推进的背景下，地方性法规中党的领导条款的设置既要遵循合宪性和合法性原则，还应该考虑到党内法规的相关要求。更多还原

【Abstract】 The provisions of party leadership in local regulations are the normative expression of “party leadership” into law, and its development history, distribution characteristics, types and influencing factors can be sorted out and analyzed, which can help to set up the party leadership provisions in local regulations at the doctrinal level. From the historical development process, under the influence of the central legislative concept,the setting of party leadership provisions in local regulations has generally gone through three stages, namely,the stage of rarely including party leadership provisions, the stage of increasing party leadership provisions, and the stage of scaling up party leadership provisions. In terms of distribution characteristics, the number of party leadership provisions in local regulations is positively correlated with the political strength of the legislative content and the legislative level, and the location is concentrated in the general part. In terms of sample types,according to the content of the provisions, there are three main types of party leadership provisions in local regulations: principle-based provisions, authority-based provisions, and obligation-based provisions. From the perspective of influencing factors, local legislative authority is the basis for setting party leadership provisions in local regulations, the relevant provisions of intraparty rules and regulations constitute an important consideration for whether to set party leadership provisions in local regulations, and the enforceability constitutes the target pursuit for setting party leadership provisions in local regulations.
