【摘要】 网络文学是指以互联网为载体的原创文学作品,其版权问题成为平台与作者最为关注的争议焦点。“版权平台化”是作者将网络文学将作品的版权全部或部分的交由平台运营。在版权平台背景下,网络文学作者的作品发表权、署名权、修改权、保护作品完整权,以及作品的使用权、处分权、收益权容易受到侵害。究其原因,在于版权利益分配失衡、平台运营模式存在缺陷、作者权利意识淡薄等。对此建议制定合理的版权分配规则、通过政企合作规制平台行为,加快相关立法速度、优化作者权利救济途径等措施,探索一条平台与作者互利共赢的和谐发展之道。更多还原

【Abstract】 Online literature refers to original literary works based on the Internet,and the copyright issue has become the focus of controversy for platforms and authors. "Platformization of copyright" means that online literature authors hand over all or part of the copyright of their works to the online literature platform for operation,gradually forming the basic state of current online literature operations.The rights to publish,famous,modify,and protect the integrity of the works of online literature authors,as well as the rights to use,dispose of,and benefit from the works are easily infringed.The reasons for this are the imbalance in the distribution of copyright interests, the flaws in the platform operation model,and the weak awareness of authors’ rights.In this regard,it is suggested to formulate reasonable copyright distribution rules,regulate platform behavior through government-enterprise cooperation,speed up relevant legislation,optimize author rights relief methods,and other measures, and explore a harmonious development path for mutual benefit and win-win between platforms and authors.更多还原
