【摘要】 金融法理念是金融法的应然规定性和思想灵魂。现代金融体系视野下的金融法理念包括社会本位、契约治理、包容审慎三重向度。其要求金融法在健全高度普惠性的现代金融体系上，采取“内生与外生相结合，以内生为主”的发展模式；在健全高度适应性的现代金融体系上，遵循“诱致与强制相结合，以诱致为主”的变迁路径；在健全高度竞争力的现代金融体系上，选择“市场和政府相结合，以市场为主”的行进道路。我国金融法的制度表达理应信守上述理念。更多还原

【Abstract】 The ideas of financial law are its due nature and conceptual soul. The ideas of financial law from the perspective of modern financial system include three dimensions of society as the standard,governance through contract, inclusiveness and prudence, which require financial law to adopt a development model of "combining endogenesis and exogenesis with focus on the former" in terms of improving the inclusiveness of modern financial system, to follow the transformation path of "combining inducement and compulsion with focus on the former" in terms of improving the adaptability of modern financial system, and to choose the advancement approach of "combining market and government with focus on the former" in terms of improving the competitiveness of modern financial system. The institutional expression of China’s financial law should be carried out by adhering to the above ideas.更多还原
