【Abstract】 In the intellectual property system of traditional Chinese medicine, technical secrets are unique.TCM technical secrets are not only the crystallization of collective wisdom, but also have independent property qualification in legal sense. Its realization of market-oriented transfer and benefit sharing has a theoretical basis, and its application is provided by the corresponding transfer system, while the conflict between individual interests and public interests in the process of sharing is filled by the benefit sharing theory. Interest sharing is the inevitable requirement of the group characteristics of the technical secrets of traditional Chinese medicine, and the transfer of the technical secrets is the concentrated embodiment of the idea of interest sharing.
