【摘要】 作为民法典中新增设的一项重要制度，离婚冷静期制度是对我国长期以来民事立法和司法实践经验的理性总结和法律确认。在肯定“离婚冷静期”维护婚姻稳定、矫正离婚恣意、防止冲动草率离婚的积极意义的同时，还需认识到离婚冷静期制度尚有不足。本文从分析我国离婚冷静期制度的内涵这一角度切入，探讨学界对离婚冷静期制度的争议，提出离婚冷静期制度之适用问题、例外问题，探寻增设多种制度共同解决离婚纠纷的路径，以期实现登记离婚冷静期与诉讼离婚程序的更好衔接。更多还原

【Abstract】 As an important system newly added in the Civil Code,the system of divorce calm down period is a rational summary and legal confirmation of China’s long-term experience in civil legislation and judicial practice.While affirming the positive significance of formally establishing the “divorce calm down period”in the registration of divorce in the Civil Code of China,which is implemented nationwide to maintain the stability of marriage,correct the arbitrariness of divorce,and prevent impulsive and hasty divorce,we should also see that the overall system of divorce calm down period still needs to be further improved.From the perspective of analyzing the connotation of the divorce calm down period system in China,this paper probes into the dispute over the divorce calm down period system in the academic circle,puts forward the application and exception of the divorce calm down period system,and further ponders the addition of multiple systems to jointly resolve divorce disputes,so as to achieve a better connection between the registration calm down period and the litigation divorce procedure.更多还原
