【摘要】 依法治校作为依法治国的重要组成部分，是推动高等教育法治化的必然选择。大学章程作为高校推进依法治校的校内基本依据，能够推动高校依法办学、依法治教。随着2017年1月《统筹推进世界一流大学和一流学科建设实施办法（暂行）》的发布，以及《中华人民共和国高等教育法》《中华人民共和国教育法》等上位法完成修正，部分高校与时俱进地启动了章程修订工作，其中有16所高校已完成章程修订，分别在培养目标、大学职能、治理结构等方面对原有章程进行了修改，使章程得到了完善。但截至2021年12月，仍有97所教育部及中央部门所属高校尚未完成章程修订工作，且已完成修订工作的高校章程，也在理念、程序、结构以及内容上存在一定的不足，同时缺少监督与执行方面的明确规定。建议各高校在章程修订工作中，要树牢法治观念，规范修订程序，推动多元主体参与，并且强化监督与执行，确保章程修订工作高质量完成，为依法治校提供坚强的制度保障。更多还原

【Abstract】 As an important part of governing the country according to law, governing schools by law is an inevitable choice to promote the legalization of higher education. University charters, the fundamental basis of internal managing by law in colleges, can boost colleges and universities to run school and teach according to law.With the release of the Implementation Measures for Comprehensively Promoting the Construction of World-class Universities and First-class Disciplines(Provisional) in 2017, and since the Higher Education Law of the PRC, the Educational Law of the PRC have been amended, some universities have revised their internal charters keeping pace with the times. Among them, the original charters of 16 universities have been reformulate and improved in terms of Training Objectives, University Functions, Governance Structure.However, until December 2021, 97 universities affiliated to the Ministry of Education and the Central Departments have not completed the amendment of the charters. In addition, some revised University Charters still have deficiencies in concept, procedure, structure and content, and lack of clear provisions on supervision and implementation.It is suggested that universities should strengthen legal sense and regulate the procedure of revision. By propelling the participation of multi-subject, intensifying supervision and implementation, the revision of charters will be fulfilled with high quality, which ensure a powerful system security for governing schools by law.更多还原
