【摘要】 运用逻辑方法解析体育赛事版权内涵，指明体育赛事版权存在的理论困境，提出相应的破解之道，从而为体育赛事版权保护夯实理论基础。研究认为，体育赛事版权内涵是指在作者权、版权体系下，基于“体育赛事”的作品定性而形成的体育赛事版权的权利内容、权利归属和权利保护等特性的总和；体育赛事版权的理论困境主要表现为作者权体系下体育赛事版权的认知分化、版权体系下体育赛事版权的认知混同，以及应然权利下体育赛事版权的理论局限性等内容。建议：法律上明确“体育赛事”的作品属性，从制度上保证体育赛事版权的理论根基；理论上强调体育赛事版权的整体性，从逻辑上避免体育赛事版权的内容割裂和认知局限；权利上廓清体育赛事版权的内外关系，从范围上为权利主体指明权利边界。更多还原

【Abstract】 Using the logical method, the author analyzed the connotation of sports event copyright, pointed out the theoretical dilemma of sports event copyright, and then put forward the corresponding solutions, so as to lay a solid theoretical foundation for the protection of sports event copyright. The research shows that the connotation of sports event copyright refers to the sum of the characteristics of sports event copyright, such as right content, right ownership and right protection, which are formed based on the characterization of "sports event" works under the author’s right and copyright system. The theoretical dilemma of sports event copyright is mainly manifested in the cognitive differentiation of sports event copyright under the author’s right system, the cognitive confusion of sports event copyright under the copyright system, and the theoretical limitations of sports event copyright under natural rights. Suggestions: Clarify the work attribute of "sports events" in law and ensure the theoretical foundation of sports event copyright from the system; Theoretically, emphasize the integrity of sports event copyright, and logically avoid the content fragmentation and cognitive limitations of sports event copyright; In terms of rights, clarify the internal and external relations of sports event copyright, and point out the right boundary for the subject of rights in terms of scope.更多还原
