【摘要】 限制死刑适用方面的重要举措之一就是设置死刑替代措施，而与死刑的严厉程度和威慑效果最为接近的无期徒刑理应发挥立法上最佳的死刑替代功能。鉴于目前中国刑法中规定了减刑和假释制度，实际上使得无期徒刑并非“无期”,从而影响了死刑替代功能的良好发挥。因此，对无期徒刑进行改进，设立终身监禁型的无期徒刑实属应有之义。《刑法修正案(九)》启动了立法试点，对特别重大贪污贿赂犯罪引入终身监禁制度乃是一大亮点，应当以此为契机，进一步探讨终身监禁适用范围之扩大，从而使无期徒刑的制度设计真正做到名副其实、名至实归。更多还原
