【摘要】 随着互联网经济的发展，各类网络应用程序(网络APP)违法违规收集用户个人信息的乱象密集涌现，个人信息保护形势严峻。虽然我国《个人信息保护法》已正式实施，但针对网络APP收集用户个人信息的法律规制仍存在“告知-同意”规则不够细化、侵权认定规则不明确、《消费者权益保护法》对个人信息保护力度不够、行政立法可操作性不强及刑事立法与相关立法协调性不足的问题。因此，应细化“告知-同意”规则、明确侵权认定规则、强化《消费者权益保护法》对个人信息的保护力度、增强行政立法的可操作性以及完善刑事立法与相关立法间的衔接。更多还原

【Abstract】 With the development of Internet economy, various network applications(network apps) have intensively collected users’ personal information in violation of laws and regulations, and the situation of personal information protection is severe. Although The Personal Information Protection Lawin Chinahas been officially implemented, there are still some problems in the legal regulation of online app collecting users’ personal information, such as insufficient refinement of the "inform consent" rule, unclear infringement identification rules, insufficient protection of personal information in Consumer Protection Law,weak operability of administrative legislation and insufficient coordination between criminal legislation and relevant legislation. Therefore, we should refine the "inform consent" rule, clarify the tort identification rule, strengthen the protection of personal information in Consumer Protection Law,enhance the operability of administrative legislation, and improve the connection between criminal legislation and relevant legislation.更多还原
