【摘要】 基于立法实证视角，以我国31个省份科技奖励地方立法文本为分析样本，探讨科技奖励地方立法优化路径。研究发现，科技奖励地方立法在规范科技奖励、评价科技成果、指引创新方向等方面意义重大，但各地在深入推进科技奖励制度改革的立法保障方面还存在一些差距，如科技奖励地方立法的系统性和及时性不足以及科技奖励地方立法制度设计方面的导向性、规范性缺陷等。为进一步改进科技奖励地方立法，促进科技奖励制度法治化，需要正确处理科技奖励制度改革和地方立法的关系，持续推进和保障科技奖励制度改革；科技奖励制度设计应当符合地方发展实际、充分发挥导向作用，并不断完善科技奖励监督、诚信惩戒等工作机制。更多还原

【Abstract】 Based on the legislative empirical perspective, this paper takes the local legislation texts of science and technology incentive in 31 provinces as analysis samples to explore the optimization path of local legislation for science and technology incentive.It is found that local legislation for science and technology reward is of great significance in standardizing science and technology reward, evaluating scientific and technological achievements, and guiding the direction of innovation. However, there are still some gaps in the legislative guarantee for further promoting the reform of science and technology reward system, such as the lack of systematical and timely local legislation for science and technology reward and the guiding and normative defects in the design of local legislation for science and technology reward.In order to further improve the local legislation of science and technology reward system and promote the legalization of science and technology reward system, it is necessary to correctly handle the relationship between the reform of science and technology reward system and local legislation, and continue to promote and safeguard the reform of science and technology reward system. The design of the reward system for science and technology should conform to the actual local development and give full play to its guiding role, and constantly improve the science and technology reward supervision, credit punishment and other working mechanisms.更多还原
