【摘要】 根据第五次中央民族工作会议的精神，“中华民族共同体意识”进入民族事务治理的法律规范体系，是法治命运共同体和马克思主义多民族国家建设理论相契合的实践要求。因此，可基于法的规范、价值、意义等多维视角解析中华民族共同体意识的法哲学意涵，为其内蕴价值在法律规范中的意义呈现奠定哲学逻辑基础。在中国共产党的领导下，宪法和民族区域自治制度为中华民族共同体意识提供了法律规范基础和基本法治保障。在对各民族公民间法律关系的反思性平衡中，中华民族共同体意识蕴含了现代法治的基本价值并对中国特色社会主义法治的价值内涵进行了拓展。依托共有法治精神家园，中华民族共同体意识规范与引导了国家族际整合与国民社会建构。综上，作为契合法治正义的道德法则与社会规范，中华民族共同体意识达成了德性与理性的社会性统一，彰显了“德法共治”的平衡，体现了“命运与共”的超越性关怀。更多还原

【Abstract】 Based on the spirit of the Fifth Central Conference on Nationalities, the entry of the sense of community for the Chinese nation into the legal system of governance of ethnic affairs, is the practical requirements of the community of the rule of law for Chinese nation and the Marxist theory of multi-ethnic state construction. Therefore, the legal philosophical meaning of the sense of community for the Chinese nation can be analyzed from a multi-dimensional perspective of norms, values, and significance, so as to lay a philosophical logical foundation for the presentation of its inherent value in legal norms. Under the leadership of the CPC, the Constitution and the system of regional ethnic autonomy provide the basic guarantee of the rule of law for the sense of community for the Chinese nation. During the reflective balance of legal relations among citizens of different ethnic groups, the consciousness of Chinese nation community has embodied the basic value of modern rule of law, expanding the value and connotation of rule of law of socilalism with Chinese characteristics meanwhile. Relying on the common spiritual home of rule of law, the sense of community for the Chinese nation regulates and guides the integration of national nationalities and the construction of national society. As a moral law and social norm conforming to the justice, the sense of community for the Chinese nation has achieved the social unity of virtue and rationality, demonstrating the balance of the governance by morality and law, and reflecting the transcendental concern of the shared future.更多还原
