【摘要】 互联网技术的发展及其在司法领域的应用催生了区别于传统线下诉讼的在线诉讼形式。在线质证作为在线诉讼不可或缺的一环，被司法解释分为同步质证和异步质证两种，具有不同于传统线下质证的特性和功能价值。作为一种新兴的质证形态，受理念滞后、制度初建、技术不成熟、质证环境等主客观因素的影响，它在实践运行中已暴露出某些缺陷和问题。为此，需要采取必要的应对措施以优化在线质证规则和切实保障当事人的质证权，进而实现创设在线诉讼制度的应有价值。更多还原

【Abstract】 The development of Internet technology and its application in the judicial field has given rise to online litigation forms which are different from traditional offline litigation. As a part of online litigation, online confrontation is divided into synchronous and asynchronous confrontation by judicial interpretation. It also has different characteristics and functional values from traditional confrontation. As a new form of confrontation, due to the lag of concept, preliminary establishment of the system, immature technology, confrontation circumstance and other subjective and objective factors, it has exposed certain defects and problems in the practical operation. Therefore, the necessary measures need to be taken to optimize the rules of online confrontation and effectively protect the parties’ right in order to realize the value of the creation of the system.更多还原
