【摘要】 随着网络技术的运用和发展，电子出版合同已经广泛运用于期刊出版发行中，目前电子出版合同订立中存在的法律问题是网络时代期刊出版发行中需要关心的课题。文章从《中华人民共和国民法典》视域下对期刊社和著作权人何时受到合同的约束以及在缔约协商过程中，作者的投稿行为、撤稿行为、期刊社的录用行为如何认定进行探讨，认为完善在线投稿协议，设立版权转让合同确认书制度可以明确双方权利和义务的承担，推进依法治刊。更多还原

【Abstract】 Electronic publishing contract has been widely used in periodical publishing and distribution with the application and development of network technology. The legal problems existing in the signing of electronic publishing contracts is a topic need to be paid attention to in the periodical publishing and distribution in the network era. This paper discusses when periodical press and the copyright owner are bound by the contract and how to identify author’s submission, withdrawal, and employment of the periodical press from the perspective of Civil Code of the People’s Republic of China. Efforts made on improving the online submission agreement, establishing the confirmation rules of copyright transfer contract can clearly identify the rights and obligations of both parties, and promote the management of journals according to law.更多还原
