【摘要】 在人工智能技术加持下，自主性武器带来军事利好的同时，也引发了人道主义危机。为此，“有意义的人类控制”这一理念被作为应对挑战的重要措施提出，引起了国际社会的广泛讨论与支持，成为了自主性武器军控的指引性理念。然而，对该理念的既有界定尝试存在缺陷，国际社会必须转换思维。从法理和实践上来说，运用国际法来界定“有意义的人类控制”是务实且高效的。基于国际法作为法律规范的特殊性，应当对“有意义的人类控制”的主体、范围、目的做出符合国际法特色的安排，且通过在CCW框架下形成“有意义的人类控制”法律原则的方式对自主性武器实施规制。更多还原

【Abstract】 With the assistance of AI technology,autonomous weapons have not only brought military benefits,but also raised humanitarian concerns in the international community.Therefore,the idea of“meaningful human control”has been put forward as an important measure to deal with the challenges,which has aroused extensive discussion and support from the international community and become the guiding concept in the arms control discussion of autonomous weapons. However,the existing attempts to define it are flawed,and the international community must change its way of thinking. Legally and practically,it is practical and efficient to use international law to define this idea. Based on the particularity of international law as a legal norm,it is necessary to define“meaningful human control”idea’s subject,scope,and purpose in accordance with the characteristics of international law. The international community should regulate autonomous weapons by establishing the legal principle of“meaningful human control”under the framework of CCW.更多还原
