【摘要】 未成年人个人信息保护是我国个人信息保护事业中的重要部分。但既有的社会实践面临着忽视未成年人的特殊需求、疏忽社会情境的复杂性以及企业合规不尽人意的困境。现有的法律规定也面临着“赋权与保护”和“个性化与平均年龄”这两大争议。当重申未成年人利益是未成年人个人信息保护的核心，并且在相涉的利益之间确立“公共利益>未成年人利益>企业利益”的排序时，未成年人个人信息保护路径的构建就可以应对上述困境与争议。因此，未成年人个人信息保护路径的构建应坚持以未成年人利益保护为目标，在推动未成年人、父母和学校各负其责的基础上，强调企业社会责任以约束企业对经济利益的谋求，同时倡导监管机构履职尽责以规范企业的信息处理行为。更多还原

【Abstract】 Minors’ personal information protection is an important part of personal information protection territory in China. However, the existed social practice is facing with the dilemma of ignoring the special needs of minors, ignoring the complexity of social situations and unsatisfactory compliance of enterprises. The existed legal provisions are also facing with two major controversies, which are empowerment and protection and personalization and average age. When reiterating that the interests of minors are the core of the protection of minors’ personal information, and establishing the order of public interest, minor interest and business interest, the path construction of minors’ personal information protection can be coped with the above difficulties and disputes. Therefore, the path construction of minors’ personal information protection should adhere to the interests of the minors as the goal, to promote individual minors, parents and the school, on the basis of the emphasis on corporate social responsibility in order to constraint enterprises seeking for economic benefits, at the same time, advocating regulators started responsible to regulate the behavior of enterprise’s information processing.更多还原
