电力设施与野生动物保护相互妨害的处理原则

【摘要】 处理在规划、运营、后期管理过程中的电力设施与野生动物保护利益相互影响相互妨害问题,本质上是协调能源的开发、利用与生态环境保护的问题。现阶段,电力设施与野生动物分别保护的很多问题都可以在现有法律框架内通过对条文的解释、修正抑或新设加以解决。然而,当电力设施与野生动物保护出现相互妨害时,最大难题或许是处理妨害原则与方法的选择。从现行法律规定与实践中电力设施与野生动物保护的做法中凝练出预防为主原则,多元、多样保护原则和最小化风险原则,并以此为指导提出处理电力设施与野生动物保护相互妨害的建议,既是对“双碳”背景下处理新能源与生态环境治理的思考,也是解决电力设施与野生动物保护相互妨害的有益尝试。

【Abstract】 Dealing with the mutual influence and mutual interference between power facilities and wildlife protection interests in the process of planning, operation and post-management is essentially a problem of coordinating the development, utilization and ecological environmental protection of energy. At this stage, many issues related to the separate protection of electric power facilities and wild animals can be resolved within the existing legal framework through the interpretation, amendment or new establishment of the provisions. However, when there is a mutual obstacle to power facilities and wildlife protection, the biggest challenge might be the choice of principles and methods to deal with the nuisance. From the current legal provisions and practices of power facilities and wildlife protection, the principle of prevention, the principle of diversified and diverse protection and the principle of minimizing risks are condensed, and the suggestions for dealing with the mutual harm between power facilities and wildlife protection are put forward under the guidance of this guide, which is not only a reflection on the treatment of new energy and ecological environment governance in the context of “double carbon”, but also a useful attempt to solve the mutual obstruction of power facilities and wildlife protection.
