【摘要】 教育作为个体成长与民族发展的现代百年大计，贯穿社会成员一生的家庭教育、学校教育和社会教育及其法治共同构成了一个国家的教育法治体系。通过全面阐释家庭教育在教育对象、教育场所、教育手段、教育过程、教育目标等方面不同于其他教育阶段和教育形态的特点，重申了家庭教育及其法治的基石性地位;通过比较分析家庭教育立法的公私交融社会法部门属性、主次有别的法律主体、开放多元的教育内容、复合立体的法律关系、隐显合一的实施机制等特点，从法律制度的四大规范构成要素——理论体系、规则体系、组织系统和支持系统入手，以构建家庭教育法、学校教育法、社会教育法为主体的高效能动的中国特色教育法治系统为落脚点，提出了未来家庭教育法融入中国特色教育法典的具体路径。更多还原

【Abstract】 Education,as a modern centennial project of both individual growth and national development,constitutes a country’s education law system through family education,school education,social education and the rule of law throughout the whole life of social members. This paper expounds the characteristics of family education which is different from other education stages and forms in the aspects of educational object,educational space,educational means,educational process and educational objectives,and reiterates the cornerstone status of family education and its rule of law. And then through the comparative analysis of the characteristics of family education legislation,including the public and private law integration legal department attributes,the coexistence of primary and secondary legal subjects,the open and diversified education content,the collective and three-dimensional legal relations,the combination of implicit and explicit enforcement mechanisms. From the four major normative components of legal institution-theoretical system,rule system,organization system and support system,in order to construct an efficient and dynamic rule of education law system among family education law,school education law and social education law with Chinese characteristics,this paper puts forward the concrete path of integrating family education law into the future Education Law Code with Chinese characteristics.更多还原
