境外部分国家档案利用救济法条对比分析及其启示

【摘要】 新修订《档案法》中首次明确地提出了档案利用权利救济途径,但有关档案利用权利救济制度如何尽快完善并有效实施等仍需要深入研究探讨。笔者对澳大利亚、新西兰、丹麦、日本、法国、美国等国家档案法律中有关档案利用救济的条款进行梳理总结并对比分析,提出了需尽快制定档案利用救济相关制度,完善档案利用权利保障体系、设计具体可行的档案救济程序,规范档案救济行为准则、加强与其他法律的衔接,协调救济权利适用性及建立多元主体参与监督机制,规范自由裁量权等建议和措施,以期为我国档案利用救济制度的建设及完善提供参考和借鉴。更多还原

【Abstract】 In the newly revised ’Archives Law’, the remedy way of Archives utilization right is put forward clearly for the first time, but how to perfect the remedy system of Archives utilization right as soon as possible and implement it effectively still needs further research and discussion. The author summarizes and compares the provisions of Archives utilization relief in the Archives laws of Australia, New Zealand, Denmark, Japan, France, the United States and other countries, and puts forward the formulation of Archives utilization relief related systems, improve the protection system of Archives utilization right, and design specific and feasible Archives utilization relief procedures. Some suggestions and measures, such as standardizing the code of conduct for archival use relief, strengthening the connection with other laws, coordinating the applicability of the right of relief, establishing the supervision mechanism involving multiple subjects, and standardizing the discretionary power, are expected to provide reference for the construction and improvement of archival use relief system in China.更多还原
